Reckless Driving
"Reckless" driving entails driving a vehicle with wanton disregard for a person or individual or property." Vehicle Code Section 23103 represents the non-injury statute which requires willful or intentional disregard for the safety of others. It is not necessary to establish intent to injure person or property. Vehicle Code Section 23104 "whenever reckless driving of a vehicle proximately causes bodily injury to any person other than the driver..."
These offenses are typically used as a lessor included offense of driving under the influence (VC 23152 or VC 23153).
